This Disclaimer supplements the Terms of Service and is incorporated into the Agreement. By using the Olkot platform, you acknowledge and accept the limitations and disclaimers set out below.
1. Financial Figures Are Analytical Estimates
Revenue totals, "Dead Money" alerts, purchase intent scores, estimated deal values, conversion rates, and all other financial or commercial figures displayed in the Olkot platform are analytical estimates generated by artificial intelligence analysis of conversation patterns. They are not financial records of any kind.
These figures cannot and must not be used as:
- Accounting records, bookkeeping entries, or financial statements;
- Inputs for tax filings, VAT returns, or any statutory reporting obligation;
- Supporting materials for investor presentations, pitch decks, or fundraising documents;
- Evidence in loan, credit, mortgage, or insurance applications;
- Evidence in legal or arbitration proceedings;
- A basis for payroll, commission, or bonus calculations;
- A basis for business valuation or M&A due diligence.
Margin of error: AI-generated financial estimates may have a significant margin of error depending on message volume, language ambiguity, industry-specific terminology, and conversational context. The same conversation may be classified differently over time as models are updated.
Always cross-reference any figure from Olkot against your own accounting, point-of-sale, or CRM system before making any business, financial, or operational decision. Consult a qualified accountant, financial adviser, or tax professional for any decision with material financial consequences.
Olkot accepts no liability for any business, financial, tax, or legal consequence arising from reliance on these estimates. Liability is further limited as set out in Section 23 of the Terms of Service.
2. AI-Generated Content Is a Suggestion Tool
Olkot uses artificial intelligence (currently OpenAI GPT-4o mini) to generate reply drafts, FAQ responses, conversation summaries, follow-up suggestions, wish-list extractions, and priority labels. This AI-generated content:
- Is not sent automatically. AI drafts are suggestions for your review. You must approve and send any outgoing message; no AI output is transmitted to your customers without your explicit action (unless you configure specific automated workflows, for which you assume full responsibility).
- May be factually incorrect. AI models can produce plausible-sounding but inaccurate, outdated, or contextually inappropriate content, especially for niche industries, regional expressions, or rapidly changing topics.
- May not match your brand voice. AI models do not inherently know your business tone, customer relationships, or commercial sensitivities. Review all drafts for alignment with your brand.
- Is not legal, medical, financial, or professional advice. No AI output constitutes professional advice of any kind. Do not send AI-generated content that could be construed as legal, medical, tax, or financial advice to your customers without review by a qualified professional.
- May have cultural or linguistic gaps. The Service is used in Spanish-speaking markets (LATAM and Spain) where regional dialectal variation is significant. AI models trained predominantly on general internet text may not accurately reflect local idiomatic usage or cultural context. Always review AI-generated text for appropriateness before sending.
You are solely responsible for every message sent from your account through the Olkot platform, whether drafted by AI or by you. Olkot accepts no liability for customer relationships, business outcomes, or legal consequences arising from unsupervised use of AI-generated content.
3. Voice Transcription Limitations
Voice messages received via Instagram DMs are transcribed automatically using AI speech recognition. You acknowledge that:
- Transcription accuracy varies significantly based on audio quality, background noise, speaker accent, dialect, and the presence of technical or industry-specific terminology;
- Transcripts may contain errors, omissions, or misinterpretations;
- Do not rely solely on a transcription for any legally significant communication — always listen to the original audio where the content of the message is materially important;
- Voice messages are downloaded immediately upon receipt and processed for transcription; the signed URL provided by Instagram expires shortly after download and is not retained.
4. Industry Benchmarks Are Informational Only
Industry benchmark figures shown in Olkot (available on Business plan) reflect anonymized, aggregated patterns derived from 50 or more businesses in the same industry segment. These benchmarks:
- Are provided for informational and comparative purposes only and do not constitute a guarantee of any specific business outcome;
- Reflect historical patterns at the time of the most recent aggregation run and may lag behind current market conditions;
- May not be representative of your specific geographic market, sub-niche, business model, or customer demographic;
- Are subject to the minimum group size (≥50) and differential privacy constraints described in our Privacy Policy — benchmarks for segments with fewer than 50 contributors are not displayed;
- Should not be used as the sole basis for pricing decisions, staffing, or capital allocation;
- Are derived from conversational data and do not necessarily reflect actual completed transactions or verified revenue.
Olkot makes no representation that your business will achieve results comparable to or consistent with any benchmark figure. We accept no liability for business decisions made on the basis of benchmark data.
5. Sensitive Financial Data in DMs
Olkot automatically detects and masks certain structured financial data (credit/debit card numbers, IBAN/bank account numbers) found in incoming DMs before they are stored. When detection occurs, a warning is shown in the conversation view.
However, you must be aware that:
- Pattern detection is not infallible. Unusual formatting, deliberately obfuscated data, or novel card schemes may not be detected;
- Once masked, the original data is not retained — if the masking was incorrect, you cannot recover the original;
- Olkot is not PCI-DSS certified and is not a payment data processor. Do not instruct your customers to send payment card details, bank credentials, or sensitive financial information via Instagram DMs;
- Any payment or financial data handling must be done through a PCI-DSS compliant payment processor or a PSD2-regulated payment service provider.
Olkot accepts no liability for data breaches, unauthorized access, or regulatory fines arising from the transmission of payment or financial data through the Instagram messaging infrastructure.
6. Instagram and Meta Platform Dependency
The core functionality of Olkot — receiving DMs, sending replies, accessing conversation history — depends on your Instagram account and on Meta's Platform APIs, which are entirely outside Olkot's control. Specifically:
- API changes: Meta may modify, restrict, deprecate, or discontinue API features at any time, with or without advance notice. Olkot will use commercially reasonable efforts to adapt, but cannot guarantee continuity of any specific feature;
- Account restrictions: Meta may restrict, suspend, or terminate your Instagram account or your API access at any time for any reason, including for perceived violations of Instagram's policies, regardless of whether such violations relate to your use of Olkot. Olkot has no influence over Meta's account moderation decisions;
- Message delivery: Olkot cannot guarantee that all Instagram DMs sent to or from your account will be delivered, received, or displayed in the platform. Meta's delivery infrastructure is subject to its own limitations and reliability standards;
- Webhooks and real-time events: Real-time DM notifications depend on webhook delivery from Meta/Unipile. Network interruptions or platform outages may cause delays in message display;
- Account type requirement: Only Instagram Business and Creator accounts can access third-party DM APIs. Personal accounts are not supported. If your account is downgraded by Meta to a personal profile, DM access will cease.
Olkot is not responsible for loss of DM access, missed customer messages, business disruption, or commercial consequences arising from Meta's platform decisions, API availability, or changes to Instagram's policies.
7. Service Availability and Data Integrity
The Olkot platform is provided over the internet and depends on multiple infrastructure components. You acknowledge that:
- The Service may be temporarily unavailable due to scheduled maintenance, infrastructure failures, security incidents, or third-party outages;
- Olkot does not guarantee that DM Content, business metrics, or other data displayed in the platform is complete, real-time, or free of errors introduced by synchronization delays;
- While Olkot maintains backups of account data, backup recovery is not instantaneous and is not a substitute for maintaining your own records of business-critical information;
- Processing of Instagram webhook events (new messages, reads, account events) occurs asynchronously via a queue system; in the event of a queue backlog, DM display may be delayed.
8. No Professional Advice
Nothing in the Olkot Service, including AI outputs, financial estimates, industry benchmarks, conversation summaries, or any other feature, constitutes legal, financial, accounting, tax, medical, regulatory, or any other form of professional advice.
Olkot is a productivity and analytics tool for small businesses. All decisions made on the basis of information shown in the platform are made by you, at your sole discretion and responsibility. For professional advice in any domain, consult a qualified and licensed professional in the relevant field and jurisdiction.
9. Limitation of Liability for Estimates and AI Outputs
To the fullest extent permitted by applicable law, Olkot's liability for any loss, damage, or consequence arising from:
- Reliance on financial estimates, Dead Money alerts, or purchase intent scores;
- Use of AI-generated reply drafts, summaries, or classifications;
- Voice transcription errors;
- Industry benchmark data;
- Unavailability of the Instagram/Meta integration;
…is limited in accordance with Section 23 of our Terms of Service (Limitation of Liability). This includes the exclusion of consequential, indirect, or punitive damages, and the cap on total liability to fees paid in the preceding 12 months.
